Emergency FMLA Leave

If you are unable to work (or telework) for reasons due to a COVID-19 circumstance relating to lack of child care, you can request an FMLA leave and be paid at 2/3 your regular rate of pay, up to a maximum of $200 per day. Emergency FMLA is only available for use from April 1, 2020, through December 31, 2020, and only for a qualifying reason occurring during that period.  FMLA is available for 12 weeks, with a two-week waiting period before you would be paid; however, the federal emergency sick days can be used for the waiting period.

For questions about  Emergency FMLA, please contact Human Resources at nhopkins@dudek-bock.com.  A form to request leave can be downloaded here:

Plant Closed April 22-28

The plant will be closed April 22 through April 28. We will re-open on April 29. All employees have used five of their 10 federal sick days. During Illinois’ shelter in place order, employees can use the other five sick days, but please let your supervisor know.

FFCPA Sick Leave Guidelines

The Department of Labor has provided guidance to employers and employees on various aspects of the Families First Coronavirus Response Act (FFCRA). Among the questions addressed is how the 10 days of federal sick leave may be taken: May I take my paid sick leave intermittently while working at my usual worksite?

It depends on why you are taking paid sick leave and whether your employer agrees. Unless you are teleworking, paid sick leave for qualifying reasons related to COVID-19 must be taken in full-day increments. It cannot be taken intermittently if the leave is being taken because:

You are subject to a Federal, State, or local quarantine or isolation order related to COVID-19;
You have been advised by a health care provider to self-quarantine due to concerns related to COVID-19;
You are experiencing symptoms of COVID-19 and seeking a medical diagnosis;
You are caring for an individual who either is subject to a quarantine or isolation order related to COVID-19 or has been advised by a health care provider to self-quarantine due to concerns related to COVID-19; or
You are experiencing any other substantially similar condition specified by the Secretary of Health and Human Services.
Unless you are teleworking, once you begin taking paid sick leave for one or more of these qualifying reasons, you must continue to take paid sick leave each day until you either (1) use the full amount of paid sick leave or (2) no longer have a qualifying reason for taking paid sick leave.

As an “essential business” Dudek & Bock can continue to operate. However, if you opt to take the federal sick leave rather than working, you should take the sick days consecutively.

Plant to Reopen on April 13

The plant will reopen on Monday, April 13. Use your own judgment whether to report for work, based on your personal circumstances. Please stay home if you or anyone in your family is sick.

If you will not be at work on Monday, call your supervisor. This is important for two reasons: we need to be able to assign jobs, and we need to know what type of day off you wish to take. The federal law granting sick leave cannot be used for a day here or there. It is intended for someone who is actually sick, or who is staying home due to a government order. Since Illinois has a “shelter in place” order, sick leave can be used for this purpose, but it should be taken consecutively. Everyone will be paid for 5 of the 10 allowed days, for the week of April 3 – April 9 (April 10, Good Friday, is a paid holiday.)

If you have any questions about leave, please contact Nancy Hopkins at nhopkins@dudek-bock.com, or ask your supervisor.
